Barcelona ArtWalk — Effective as of 2026-07-11

These terms and conditions apply to the Barcelona ArtWalk app (hereby referred to as “Application”) for mobile devices that was created by Walid Islam (hereby referred to as “Service Provider”) as an Ad Supported service.

Agreement to Terms

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

Application Modifications & Charges

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.

Data & Device Security

The Barcelona ArtWalk app stores and processes personal data that you have provided to us, to provide my Service. It's your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone's security features and it could mean that the Barcelona ArtWalk app won't work properly or at all.

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.

Third-Party Services

Please note that the Application utilizes third-party services that have their own Terms and Conditions. Below are the links to the Terms and Conditions of the third-party service providers used by the Application:

Internet & Connectivity

Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.

If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.

User Responsibility

Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.

In terms of the Service Provider's responsibility for your use of the application, it is important to note that while they strive to ensure that it is updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application.

Updates & Termination

The Service Provider may wish to update the application at some point. The application is currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the application to) may change, and you will need to download the updates if you want to continue using the application. The Service Provider does not guarantee that it will always update the application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the application when offered to you.

The Service Provider may also wish to cease providing the application and may terminate its use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device.

Pricing and Payments
  • All prices are shown in your local currency within the app.
  • Prices may vary by region and are subject to change.
  • Payment is charged to your Apple App Store or Google Play account at confirmation of purchase, and is processed through the app store and our provider, RevenueCat.
  • Purchases are one-time payments (permanent ad-free, or a 24-hour ad-free thank-you tip) — there is no auto-renewing subscription. Refunds are handled by the app store under its policies.

User Content & Community Guidelines

The Application lets you submit content — including reviews, comments, artwork reports, photos, and recorded walking tours (“User Content”). You retain ownership of your User Content, but by submitting it you grant the Service Provider a worldwide, non-exclusive, royalty-free licence to host, store, display, and use it for the purpose of operating and promoting the Service. You confirm that you own or have the necessary rights to the content you submit and that it does not infringe anyone else's rights.

You agree not to submit content that:

  • is unlawful, defamatory, hateful, harassing, obscene, or infringes intellectual-property or privacy rights;
  • is false, misleading, spam, or advertising;
  • contains another person’s private or personal data without their consent;
  • misrepresents the location, artist, or status of an artwork.

We may review, moderate, remove, or refuse any User Content, and suspend or terminate accounts that breach these terms, at our discretion. You are solely responsible for the content you submit. To report content that infringes your rights or these guidelines, contact us at snapnsolve.apps@gmail.com.

AI-Generated Content

Some features produce descriptions, recommendations, and images using third-party AI services (Google Gemini and OpenAI). AI output can be inaccurate, incomplete, or outdated, and is provided for general information and entertainment only — it is not professional, historical, or safety advice. Do not enter sensitive personal information into AI features. The Service Provider is not liable for reliance on AI-generated content.

Affiliate Links & Third-Party Bookings

The Application may show tickets, tours, and experiences from partners such as Tiqets, Viator, and GetYourGuide, and may earn a commission when you purchase through these links, at no extra cost to you. Any booking, ticket, or payment is a contract solely between you and the relevant partner and is governed by that partner's terms. The Service Provider is not the seller, does not process these bookings, and is not responsible for the partners' products, pricing, availability, or fulfilment.

Refunds, cancellations, changes, and customer support for any ticket, tour, or experience purchased through these partners are the responsibility of the relevant partner platform and are handled solely under that platform's own refund and cancellation policy. Please direct any such request to that partner — the Service Provider cannot issue refunds or cancel bookings made on a third-party platform.

Disclaimer

The App is provided “as is” without warranties. We are not responsible for:

  • Inaccurate location or service details retrieved from Google or other third-party data sources
  • Inaccurate or outdated art-related information, which may be derived from public data sources
  • Unavailability or malfunctioning of app features due to device, network, or system limitations
  • Availability or functionality of the app features

Use of Public Information and Images

The app may contain photos and information obtained from publicly available sources. If you believe that any content within the app infringes your rights or is used without proper authorization, please contact us at snapnsolve.apps@gmail.com. Upon receiving an objection, we will promptly review and, if necessary, remove the content.

Governing Law

These terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law rules. Nothing in these terms removes any mandatory statutory rights you have as a consumer under the law of your country of residence, including your rights under EU consumer-protection law.

Changes to These Terms and Conditions

I may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. I will notify you of any changes by posting the new Terms and Conditions on this page.
